US Judge Mandates Freedom of Abrego Garcia from Immigration Detention
A federal judge has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment is without legal authority.
"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her ruling.
The case originates in a mistaken deportation to El Salvador earlier this year, which the government later acknowledged was an mistake. After his repatriation to the United States to face alien smuggling allegations, he was detained in immigration detention.
In her order, the court noted that the authorities lacks a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."

The legal challenge involve conflicting claims. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this allegation.
He has also entered a not guilty plea to the conspiracy counts, which are part of a ongoing trial in Tennessee.

The judge, who was hearing his challenge to removal in a federal court, ruled that he must now comply with the terms of his bond from jail in Tennessee. This order effectively transfers his monitoring to the Tennessee court.
