The federal appeals court has upheld a prohibition on sending state troops in the Oregon city, following a latest legal decision.

Judicial Panel Concurs to Rehear Legal Matter

The ninth circuit court of appeals decided on Tuesday that it would rehear the case concerning the president’s authority with an larger group of 11 judges. The judicial body also overturned a earlier decision from a three-judge panel that had supported the federal government.

Legal Saga Over Military Presence

This order represents the most recent development in a long-running court case over whether the former president has the legal right and valid reason to deploy national guard forces in the city. Approximately 200 federalized guard members have been in limbo since the end of September when the deployment effort was started in due to months of protests.

Differing Viewpoints

The federal government has claimed that government employees at the immigration center in the southern part of the city were under attack, while city and state officials assert that municipal police have command of the situation.

Contrary to descriptions of the city as a conflict zone, locals have been sharing footage of lush hiking trails and a vibrant culinary culture, and planning activities such as an protest bicycle event against the increased military presence.

Court Proceedings

The appeals court decision came after a US district judge in Portland issued two legal injunctions this month – one blocking the federalization of the state troops, and another prohibiting the use of any military personnel in the state, after attempts to circumvent the first order by calling up out-of-state forces.

On Monday, the ninth circuit panel had put the first ruling on hold – allowing control of 200 Oregon national guard – but the second ruling remained in place, blocking the physical sending of the forces.

The latest ruling means the matter will be heard by the full court – with all decisions under consideration together – by a group of eleven justices.

“This ruling demonstrates that the truth matters and that the judicial system are working to ensure government responsibility. The founding document restricts the executive authority, and Oregon’s communities cannot be treated as a testing site for unchecked federal authority,” stated the legal representative in a statement.

“The court is sending a definite signal: the executive leader cannot send the military into US cities without cause. We will continue defending Oregon’s laws, values, and sovereignty as this case progresses and our fight continues in the judicial system.”
